How do I obtain protection from jury trials?
Per the Administrative Judge’s instructions, please only request protection in
Greenville County Common Pleas Courts if you have a case set on the Roster and
need protection for that term of court. If you have no cases on the roster, or
if your protection needs do not coincide with the term of court the case is set
for trial, it is not necessary to request protection.
If you have a case set on a Greenville County Roster, please go to the
Greenville County Court Support Site at www.greenvillecounty.org/courtsupport
and review the memo from the Court and the form which is located under "Download Forms".
The "Court Term case is on Docket" field and the "Enter Protection Date/Dates Requested"
field must be filled out and coincide. Protection needs should be addressed when the
case is statused.

How do I obtain a continuance or notice requirement on a jury case that appears on
the roster?
Requests or motions for continuances must be sent directly to the
Administrative Judge for Common Pleas. Please do not send duplicate requests or motions
for continuances to the Judge, Court Coordinators, or the Clerk of Court. When the
Administrative Judge makes a final decision on your continuance request or motion, the
Court Coordinator will advise you of the Judge's response via fax. Notice requirements
should be requested at the Pre-Trial Conference or at the Roster Meeting the week of
the scheduled trial.

What happens if a case is not reached during the week it first appears on the roster?
Cases not reached during their scheduled term of court will be carried over to next court
term and will be repositioned numerically by case number with the cases that have already
been set for that week.

Where do I obtain a copy of an order that has recently been signed or check the
status of an order that has been submitted for the Judge's approval?

Whom do I call if a jury case has been settled?
To report the settlement of a case that has been given a trial date, please
contact Lyndall Coker, Jury Trial Coordinator, at 864-467-8510 or send an email to
lcoker@greenvillecounty.org. Please
indicate if the case has been settled fully or partially and as to whether you will
be submitting a formal order or if you would like the Court to prepare a Form 4 Order
removing the case from the Jury Docket. If a case has not been statused or is not
on a current roster, please send the settlement information directly to the Clerk
of Court.

How do I know when the next Pre-Trial Conferences are scheduled?
Greenville County is now using the Statewide Case Management/Roster System and
all Pre-Trial Conference Notices will be e-mailed when the roster is set.
All attorneys must register their e-mail addresses with the South Carolina Bar
Association. It is your responsibility to keep your e-mail addresses updated. Failure
to do so may result in you not receiving important roster information.

How and when will I be notified that a case has been set for trial on the Jury Roster?
Trial terms for cases will be determined at a Pre-Trial Conference. You will receive
notice via e-mail when your case has been set on the Pre-Trial Conference Roster.

To receive protection from non-jury trials, you must complete the Motion for Protection form
found under Download Forms and e-mail the form to the appropriate court coordinator. When
a decision is made by the Administrative Judge, you will be notified via e-mail.

To report the settlement of a non-jury case please immediately contact the
Non-Jury Coordinator at (864) 467-8546. When you call please advise the Non-Jury
Trial Coordinator as to whether the case has been settled fully or partially.
Please also inform the Coordinator's Office as to whether you will be submitting
a formal order or if you would like the Court to prepare a Form 4 Order dismissing
your case.

Are Mandatory Status or Pre-Trial Conferences currently being held for cases on the
Non-Jury Trial Docket?
Status or Pre-Trial conferences are not currently being held. However, Mandatory Roster
Meetings are currently being held for non-jury cases. They are usually
held on Monday at 9:00 for the designated term with the presiding Judge.

Can I cancel or postpone a motion hearing?
Once a motion has been set with the court, you must contact the
Administrative Judge to continue a motion hearing to another term of Non-Jury motions.
The Non-Jury Court Coordinator can reschedule the motion hearing within the same week or term.
The attorney requesting to reschedule the hearing is responsible for notifying all parties of
the new day and time within the same term. Requests to withdraw or resolution notifications
should be promptly reported to the Non-Jury Court Coordinator at (864) 467-8546 or via email at njcoord@greenvillecounty.org.

Is there a requirement that all motions have an attached motion form?
Yes, all Motions must have the required motion form pursuant to an order of the Chief
Justice of the Supreme Court. You may download a copy of the motion form
here.

Do I need to contact opposing counsel with the date and time my motion has been set?
Yes, the Clerk of Court’s office will only notify the party filing the motion.
After the motion has been filed with the Clerk of Court’s office, written notice will be
mailed to the moving party within two (2) business days after filing, giving the date and
time of the motion hearing. The moving attorney/ party will be responsible for notifying all
opposing parties as to the date and time of the motion hearing.

Are there any requirements for memorandums on non-jury motions?
Many judges do have specific requirements or policies on the submission of memorandums for
pending non-jury motions. Memorandum policy requirements are sent with the written notification
to the moving party or you may review the current memorandum policy
sheet here.
