Donaldson Fire Service Area

Purpose(s)/Service(s): provides for fire protection (one member of County Council included as non-voting, ex-officio member.
Enabling Legislation: Greenville County Council Ordinance No. 977, effective 4/6/1982.
Pursuant to South Carolina Code: 4-9-10(b); 4-19-10(a)

Ordinance No. 977, pursuant to Sections 4-19-10(a) and 4-9-10(b) of the South Carolina Code of Laws (1976), as amended, created the Donaldson Fire Service Area for Donaldson Industrial AirPark. The Board consists of five members, four of whom shall be employees of industries owning or leasing property at Donaldson Industrial Air Park and one of whom shall be a member of the Donaldson Management Commission. In addition, one member of Greenville County Council shall as a non-voting, ex-officio member of the Board. All members shall serve four-year terms, but no member shall serve for more than two successive terms. Any person, firm, or corporation which pays at least twenty-five (25%) per cent of the property taxes levied for the support of the Donaldson Fire Service Area shall be entitled to one seat on the Board.

Board Responsibilities
The Board, shall have custody, possession, and control of all property, real, personal, and mixed, located at the present fire station for Donaldson Industrial Air Park, and shall be responsible for the upkeep, maintenance, and repair of all such property, the title to which shall remain in Greenville County and the City of Greenville so long as it retains an interest in Donaldson Industrial Air Park. In addition there to, the Board shall have the following duties and responsibilities:

  • To supervise the operation and maintenance of a fire protection system within Donaldson Industrial Air Park and make recommendations to Greenville County Council regarding the operation of the system.
  • To select sites of places within the service area where fire-fighting equipment shall be kept;
  • To employ all necessary fire protection personnel and recommend to County Council their compensation which shall conform to the County's Classification and Compensation Plan;
  • To supervise the training of firemen to ensure that the equipment is utilized in the best interest of Donaldson Industrial Air Park and properties located therein;
  • To be responsible for the purchase of such firefighting equipment and apparatus as it deems necessary for the purpose of controlling fires within the Donaldson Service Area;
  • To recommend to County Council such rules and regulations as it may deem proper and necessary to insure that the equipment is being used to the best advantage of Donaldson Industrial Air Park and to carry out the provisions of Chapter 19 of Title 4 of the South Carolina Code of Laws (1976), as amended.
  • To adopt its own rules of procedure and to provide for such officers as it deems necessary or advisable.
  • Except as otherwise provided herein, to do all other things, which it deems necessary for the proper management and administration of the Donaldson Fire Service Area.

The County Auditor is authorized to levy and the Tax Collector to collect an annual tax on all taxable property within the Donaldson Fire Service Area for the operation, support, and maintenance of such area. Prior to March 1 of each year, the Board shall submit to the County Administrator a proposed budget for the next succeeding fiscal year. The County Council may adopt, reject, or amend such proposed budget, which shall, in its adopted form, serve as the basis for the ad valorem tax levy for the next fiscal year. If the levy set forth in Section 5 shall be changed by the County Council, such change shall be effected by the passage of an ordinance which shall not be adopted until a public hearing is held in accordance with Section 4-9-130 of the South Carolina Code of Laws (1976), as amended.

It is unlawful to interfere with any member of the Donaldson Fire Department in the discharge of his duties or to interfere with any fire equipment used by the department. Any person committing such offense is subject to a fine not exceeding $200 or imprisonment not exceeding thirty days.
